PROPOSALS FOR DRAFTING ALENMENTS SUBMITTED BY THE UNITED KINGDOM CONVENTION (H1)

1. Article 1 In the last line "invention" should be amended to "inventions".

2. Article 2 The word "for" in the penultimate line of the second paragraph should be deleted and the word "by" should be amended to read "in". (See, for example, Article 14(3)).

3. Article 4 This Article should be amended to read:

"(1) A European Patent Organisation (hereafter referred to as "the Organisation") is hereby established. It shall have administrative and financial autonomy.

(2) The principal organs of the Organisation shall be -

  (a) A European Patent Office; and
  (b) An Administrative Council

(3) The task of the Organisation shall be to grant European patents. This shall be carried out by the European Patent Office supervised by the Administrative Council".

4. Article 5 Paragraphs 2 and 3 should be amended as follows to be fully consistent with Article 211 of the Rome Treaty:

"(2) In each of the Contracting States, the Organisation shall enjoy the most extensive legal capacity accorded to legal persons under their law; it may in particular acquire or dispose of movable and immovable property and may be party to legal proceedings. To this end, the Organisation shall be represented by the President of the European Patent Office".

ALLGEMEINE UND INSTITUTIONELLE VORSCHRIFTEN

Kapitel I Allgemeine Vorschriften Artikel 1 Europäisches Patenterteilungsverfahren Durch dieses Übereinkommen wird ein den Vertragsstaaten gemeinsames Recht für die Erteilung von Erfindungspatenten geschaffen.

Artikel 2

Europäisches Patent (1) Die nach diesem Übereinkommen erteilten Patente erhalten die Bezeichnung europäisches Patent. (2) Das europäische Patent hat in jedem Vertragsstaat, für den es erteilt worden ist, dieselbe Wirkung und unterliegt denselben Vorschriften wie ein in diesem Staat erteiltes nationales Patent, soweit sich aus diesem Übereinkommen nichts anderes ergibt.

Artikel 3

Territoriale Wirkung Die Erteilung des europäischen Patents kann für einen, mehrere oder alle Vertragsstaaten beantragt werden.

Artikel 4

Europäische Patentorganisation (1) Durch dieses Übereinkommen wird eine Europäische Patentorganisation gegründet, die eine gemeinsame Einrichtung der Vertragsstaaten ist, nachstehend Organisation genannt wird und mit verwaltungsmäßiger und finanzieller Selbständigkeit ausgestattet ist. European patent (1) Patents granted by virtue of this Convention shall be called European patents. (2) The European patent shall, in each of the Contracting States for which it is granted, have the effect of and be subject to the same conditions as a national patent granted by that State, unless otherwise provided for by this Convention.

Article 3

Territorial effect The grant of a European patent may be requested for one or more of the Contracting States.

Article 4

European Patent Organisation (1) This Convention hereby establishes a European Patent Organisation, common to the Contracting States and hereinafter referred to as the Organisation, which shall be endowed with administrative and financial autonomy. (2) The Organisation shall grant European patents. This task shall be carried out by a European Patent Office, whose work shall be supervised by an Administrative Council.

The Working Party therefore decided :

- to amend the title of article 1 and to refer to the current draft as the : "Preliminary Draft for a Convention relating to a European system for the grant of patents." - to take this amendment into account in the wording of Article 1, by not retaining the text of the 1965 Draft in its entirety.

Article 2 - European patent

8. To make clear the scope of the Convention, which relates only to the grant of patents, the Working Party wished to specify, in a new paragraph 2 a), that a European patent, after its grant, is to be regarded in every respect as a national patent in the various Contracting States. Therefore, it also deemed it useful to lay down in the same paragraph what the effects implied by such assimilation are, the list appearing in this paragraph not being restrictive. 9. In adopting Article 2, the Working Party rejected the suggestion, put forward during the discussions, in accordance with which the European Patent Office would limit itself to issuing a simple certificate, on the basis of which the national Offices would then grant national patents.

II 5. In drafting these articles, the Working Party based itself in particular on the provisions of the 1965 version of the Draft Convention relating to a European Patent Law (1965 Draft), drawn up within the EEC, and on the Draft of an open European Patent Convention, drawn up by the Member States of EPTA (EPTA Draft). In addition, as regards the provisions relating to patent law, the Working Party also based itself on the corresponding articles of the Strasbourg Convention on the unification of certain points of substantive law on Patents for Invention (1963).

Article 1 - European system for the grant of patents

7. In the examination of this Article, the question arose of whether, where appropriate, provisions could be introduced, in particular as regards revocation of the European patent, involving a harmonisation of the corresponding provisions of the national laws of the Contracting States, or whether they should in principle limit themselves to provisions concerning the grant of patents. The Torking Party finally decided to restrict itself to adopting the second solution for the present Convention. It was nevertheless aware of the interest which the first solution could present to the interested circles.

1. The first working meeting of Working Party I, set up by the Conference, was held at Luxembourg from Tuesday 8 to Friday 11 July 1969.

In accordance with the decision taken by the Working Party at its inaugural meeting held at Brussels on 21 May 1969, the Chair was taken by Dr. HAERTEL, President of the German Patent Office.

In addition to the Commission of the European Communities, the following inter-governmental organisations, which had been invited to take part in the work of the Working Party, were represented: BIRPI, the General Secretariat of the Council of Europe and the International Patent Institute (1).

Enfin, M. Zweigbejch fait savoir que le gouvernement suédois a pris connaissance de la demande du Royaume-Uni de pouvoir participer aux travaux en tant qu'observateur. Si eette demande devait être agréée, il annonce que les gouvernements scandinaves en feront une pareille.

Le Président invite ensuite i. Rosciomi a faire part au groupe de travail des résultats de la réunion du groupe de travail "Produits pharmaceutiques" (Campet). i. Roscioni déclare que ce groupe a accusilli favorablement la proposition relative à une réunion mixte avec le groupe "brevets". Le groupe "Campet" est d'accord que le groupe "brevets" soit compétent pour les questions de principe en matière de brevetabilité de produits pharmaceutiques. Cependant le groupe "Campet" se réserve de continuer les discussions au sujet d'une harmonisation on cette matière. Toutefois, cette harmonisation n'ira pas à l'encontre des dispositions de la convention européenne. K. Roscioni ajoute que les experts en matière de produits phamaceutiques prévoient des licences obligatoires basées sur l'intérêt public.

Le Président demande a M. Froschmaier de bien vouloir prendre contact avec I. Campet pour fixer une date pour la réunion mixte. Cette réunion devrait de préférence avoir lieu dans la deuxième semaine de la session du groupe "brevets" au mois de janvier 1964.

Ensuite, le Président entane la discussion du projet article par article.

Au sujet de cet article, le groupe "marques" a proposé de faire figurer au pluriel les mots "le territoire". Le groupe accepte cette proposition. L'article est transmis au Comité de rédaction.

Schliesslich teilt Herr Zweigbergh mit, dass die schwedische Regierung von Antrag Grossbritanniens, an den Arbeiten als Beobachter teilzunehmen, Kenntnis genommen habe. Für den Fall, dass diesem Antrag entsprochen werde, kündigt er an, dass die skandinavischen Regierungen den gleichen Antrag stellen würden.

Der Vorsitzende fordert Herrn Roscioni auf, die Gruppe von den Ergebnissen der Sitzung der Arbeitsgruppe "pharmazeutische Produkte" (Campet) zu informieren.

Herr Roscioni erklärt, dass diese Gruppe den Vorschlag über eine gemeinsame Sitzung mit der Arbeitsgruppe "Patente" günstig aufgenommen habe. Die Gruppe "Campet" ist damit einverstanden, dass die Gruppe "Patente" für die grundsätzlichen Fragen der Patentfähigkeit pharmazeutischer Produkte zuständig sein soll. Dagegen behalte sich die Gruppe "Campet" vor, die Beratungen über eine Harmonisierung auf diesem Gebiet fortzusetzen. Jedoch dürfe diese Harmonisierung zu den Vorschriften des europäischen Abkommens nicht im Widerspruch stehen. Herr Roscioni fügt hinzu, dass die Sachverständigen auf dem Gebiet der pharmazeutischen Produkte Zwangslizenzen auf der Grundlage des öffentlichen Interesses versehen würden.

Der Vorsitzende bittet Herrn Froschmeier, sich mit Herrn Campet zur Vereinbarung eines Termins für die gemeinsame Sitzung in Verbindung zu setzen. Diese Sitzung solle möglichst in der zweiten Woche der Sitzung der Arbeitsgruppe "Patente" im Januar 1964 stattfinden.

Darauf eröffnet der Vorsitzende die Beratung des Entwurfs nach Artikeln.

Artikel 1 Zu diesem Artikel hat die Gruppe "Marken" vorgeschlagen, die Worte "le territoire" im Plural erscheinen zu lassen. Der Artikel wird an den Redaktionsausschuss überwiesen.

Article 1. European patent law

This Convention hereby establishes a system of law concerning patents for invention, common to the Contracting States and applicable in the territory of these States, and known as the European patent law.

Article 2. European patents

(1) Patents conferring exclusive rights on their proprietors shall be granted under the name of ' European patent' in accordance with the provisions of this Convention. (2) European patents shall have a unitary and autonomous character. The unitary aspect arises from the fact that they shall have effect on the territory of all Contracting States and may only be assigned or permitted to lapse in respect of the whole of this territory. Their autonomous character is ensured by virtue of the fact that they are subject only to the provisions of this Convention.

Article 3. European Patent Office

European patents shall be granted by a patent office common to the Contracting States, which shall be called the ' European Patent Office '.

Article 4. European Patent Court

A court common to the Contracting States, hereinafter called the ' European Patent Court ', shall be competent to deal, in the final instance, with actions relating to European patents, to the extent to which jurisdiction is conferred on it by the Convention.

Notes:

1. A separate instrument will prescribe the organisation and procedure of the European Patent Court; the question whether this court will be attached to an already existing international court is left open. 2. This Article will require to be supplemented in the event of certain actions referred to in Articles 39, 40 and 208 of this Convention falling within the jurisdiction of a Court other than the European Patent Court.

Article 5. Persons entitled to apply for European patents

1st Variant Any person desiring to obtain protection for his invention for the whole of the territory of the Contracting States, may apply for a European patent.

2nd Variant

(1) Any natural or legal person or any body equivalent by virtue of national law, to a legal person, possessing the nationality of one of the Contracting States, who desires to obtain protection for his invention for the whole of the territory of the Contracting States, may apply for a European patent.

Ie Président fait remarquer qu'on aurait pu souliGner le fait que l'unité du brevet européen est déjà réalisée par la délivrance. Il n'insiste pas sur ce point. I'artiole est adopté.

Artiole 3 (3) adopté sans discussion.

Artiole 4 (4) M. ran Benthem explique que l'ancien paragrapie 2 a été transformé en remarque. i. de Murser demande de savoir qui décidera de la Convention spéciale précisant l'organisation et le fonctionnement de la Cour curopéenne des brevets.

Le Président lui répond que cette Convention devrait être élaborée par le groupe de travail ensemble avec les représentants des ministères de la justice. M. van Benthem ajoute à son explication que l'ancien texte avait énoncé les actions en nullité. La rédaction actuelle est plus large et comprend entre autres les actions en ratiere des licences obligatoires.

Artikel 1 (1) Herr van Benthem betonte, dass os sich bei don Anderungen dieses Artikels nur um eine genauere Ausdrucksweise auf Wunsch der französischen Delegation handele, nicht jedoch um inhaltliche Anderungen. Der Artikel wurde angenommen.

Artikel 2 (2) Herr Sünner wies darauf hin, dass im deutschen Text das Wort "territoire" (Gebiet) wie in Artikel 1 durch das Wort "Hoheitsgebiet" übersetzt werden müsse.

Der Vorsitzende bemerkte, man hätte noch darauf hinweisen können, dass die Einheitlichkeit des europäischen Patents bereits mit dessen Erteilung gegeben sei; er bestand jedoch nicht auf einem entsprechenden Zusatz. Der Artikel wurde angenommen.

Artikel 3 (3) Der Artikel wurde ohne Diskussion angenommen.

Artikel 4 (4) Herr van Benthem erklärte, der frühere Absatz 2 sei in eine Bemerkung umgewandelt worden.

Herr de Muyser stellte die Frage, wer das besondere Abkommen vorbereiten solle, das die Einrichtung und Arbeitsweise des Europäischen Patentgerichts festlege.

Hierauf antwortete der Vorsitzende, dieses Abkommen solle von der Arbeitsgruppe gemeinsam mit den Vertretern der Justizministerien ausgearbeitet werden.

Herr van Benthem erklärte weiter, die frühere Fassung habe das Nichtigkeitsverfahren betroffen. Die Neufassung sei jedoch weiter und umfasse unter anderem auch das Verfahren auf Erteilung einer Zwangslizenz.

Les modifications proposées par le projet français sont d'ordre rédactionnel.

Es geht darum, ob das Wort "gemeinsam" gestrichen werden soll. Herr van Benthem ist gegen die Streichung, um deutlich zu machen, daß es sich um ein Patent handele, das von einer gemeinsamen Instanz erteilt worden sei. Nach einem Vorschlag von Herrn Fressonnet wird beschlossen, für die Vertragsstaaten ein gemeinsames Recht vorzusehen, das im Gebiet dieser Staaten Geltung habe.

Artikel 2

Die im französischen Entwurf enthaltenen Änderungen sind redaktioneller Natur.

Artikel 3

Der Artikel wird dem Redaktionsausschuß überwiesen.

Artikel 4

Für die Arbeitsgruppe steht noch nicht fest, für welche Klagen das gemeinsame Gericht zuständig sein wird. Das gleiche gilt für die Frage, velches internationale Gericht entscheiden soll.

L'article 1 est approuvé sous réserve de quelques remarques rédactionnelles.

L'article 2 est adopté et transmis au Comité de rédaction. La question du territoire des Etats contractants sur lesquels la Convention sera applicable sera réglée dans les dispositions finales.

L'article 3 est adopté.

Article 4. Le groupe approuve une suggestion de MM. De Reuse, De Muyser et van Benthem de ne pas donner une énumération exhaustive des compétences du tribunal européen.

Le groupe discute ensuite les diverses possibilités d'établissement d'un tel tribunal européen.

Le Président remarque que la question de la création d'un tel tribunal sera tranchée définitivement par le Comité de coordination et les Secrétaires d'Etat. Il souligne la nécessité d'une telle instance européenne qu'on devrait appeler Cour, afin de pouvoir assurer l'unité du droit européen.

Le groupe admet qu'il faut trouver une formulation suffisamment souple pour couvrir toutes les possibilités en vue de résoudre ce problème rationnellement.

L'article 4 est transmis au Comité de rédaction avec des remarques d'ordre formel.

Artikel 2 wird angenommen und an den Redaktionsausschuss überwiesen. Die Frage des Gebietes der Vertragsstaaten, in denen das Abkommen gol ton soll, wird in den Schlussbestimmungen geregelt.

Artikel 3 wird angenommen. Artikel 4. Die Gruppe billigt die Anregung der Herren De Rause, De Muyser und van Bonthem, die Zuständigkeiten des curopäischen Patentgerichts nicht orschöpfend aufzuzählen.

Die Gruppe erörtert anschliessend die verschiedenen Möglichkeiten zur irrichtung eines solchen curopäischen Gerichts.

Der Präsident erklärt, die Frage der Bildung eines Gerichts werde abschliessend durch den Koordinierungsausschuss und die Staatssekrotäre behandelt. Er weist auf die Notwendigkeit einer solchen europäischen Instanz, die als Gerichtshof bezeichnet werden sollte, zur Wahrung der Einheitlichkeit des europäischen Rechtes hin.

Nach Ansicht der Gruppe muss eine Formulierung gefunden werden, die elastisch genug ist, um alle Möglichkeiten für eine vernünftige Lösung dieses Problems zu erschöpfen.

Artikel 4 wird mit Bemerkungen formeller Art an den Redaktionsausschuss überwiesen.

Die Sitzung wird um 13 Uhr geschlossen.
